One member submitted a written request. This is the documented chronology of what followed.

As a registered member of an Ontario non-profit, the applicant submitted requests for certain records from the organization, citing rights set out in the Ontario Not-for-Profit Corporations Act. Context

On March 24, 2026, the Future of Sport in Canada Commission released its Future of Sport in Canada Commission Final Report — Transforming Sport in Canada: Time for Action. Commissioner Justice Lise Maisonneuve and her team spent nearly two years conducting cross-country consultations before issuing 98 Calls to Action. Among its central findings: governance across the Canadian sport system is inconsistent, inadequately transparent, and in need of fundamental reform. Chapter 14 of the report addresses sport governance specifically, calling for mandatory governance standards and greater accountability across all levels of sport organizations.

The issues raised in this proceeding touch on governance themes discussed in the Commission’s report, including transparency, accountability, and member access to information. The Commission’s findings apply across the Canadian sport system broadly; this site makes no assertion about this organization’s governance specifically.

A third list was provided. The address listed for every member was 705 Matheson Boulevard East, Mississauga — the organization’s registered address. The applicant took the position that the list did not satisfy O. Reg. 395/21, s. 6(3) because it did not contain individual member addresses or membership start dates. The adequacy of the register produced remains in dispute before the court. The organization stated it had engaged legal counsel specializing in ONCA at the cost of the association.

On October 2, 2025, a written request was made for the organization’s financial statements for fiscal years ending June 30, 2022 through June 30, 2025. The Treasurer responded that audits had not been performed in those years and that audited statements available were those already posted on the organization’s website. The applicant alleges that no financial statements were produced in response to the request. Whether the organization was required to produce them is among the issues before the court. The parties disagree about the organization’s obligations regarding financial statements under ONCA.
